On Feb. 21, 2020, Rady Children’s Hospital in San Diego issued a press release regarding a data breach involving patient information centered on services provided in Rady’s radiology department from June 20, 2019 to Jan. 3, 2020. The release indicates Rady was notifying 2,360 patients whose patient information may have been accessed.
On Feb. 27, 2020, Haeggquist & Eck, LLP filed a proposed class action on behalf of a Rady patient impacted by the data breach in the Superior Court of the State of California, County of San Diego. The lawsuit is pending under the case name: R.O. a Minor by and Through Cara O., Parent and Guardian ad Litem v. Rady Children’s Hospital – San Diego, Case No. 37-2020-00011841-CU-BT-CTL.
The Plaintiff in the lawsuit seeks to certify a class of “[a]ll persons who were treated in Rady Children’s Hospital-San Diego and/or its medical center or emergency room at any time from June 20, 2019 to January 3, 2020, and whose confidential medical information was disclosed without authorization.” The lawsuit seeks damages and other relief based on Rady’s alleged negligence, as well as alleged violations of state statutory law including California’s Confidentiality of Medical Information Act and California Business & Professions Code §17200 (prohibiting unlawful, unfair, and/or fraudulent business practices).
